Law 37/2007 of 16 November on the Reuse of Public Sector Information, which transposes Directive 2003/98/EC of the European Parliament and of the Council, regulates the reuse of public sector information held by public administrations and bodies in which they hold a majority interest. This legislation recognises the right of all potential market participants to reuse information made available by public authorities.
In accordance with this legislation, the Administration authorises the reproduction, distribution and public communication of its works, as well as their transformation for the creation of derivative works, worldwide and without time limitation, provided that such reuse does not conflict with any specific licence or notice applicable to a particular work.
The following conditions must be respected when reusing information:
a) The meaning of the information must not be altered or distorted.
b) The source of the information must always be cited.
c) The date of the latest update of the information must be indicated.
The author or rights holder must always be acknowledged as:
MIDIT (Association for the Integral Development of the Territory of Vandellòs i l’Hospitalet de l’Infant, Tivissa and Pratdip).
Other Forms of Reuse
The reuse of information may also be restricted in order to protect other legally protected interests, such as personal data, privacy or the intellectual property rights of third parties.
The reuse of works protected by intellectual property rights may be governed by open-content licences, such as Creative Commons licences, which grant certain rights for the use of the works. Where such licences apply, reuse shall be permitted under the conditions established therein.
Under no circumstances is the use of MIDIT logos, trademarks, coats of arms or other distinctive symbols authorised in publications or websites that are not managed, sponsored or endorsed by MIDIT. These corporate identity elements are the exclusive property of MIDIT and are protected by applicable legislation.
